She fasted even though she was not sure that her period had ended

A woman fasted while she is not sure if she is pure of her menstrual period. The next day she was sure that she is pure. What is the ruling on fasting the day she doubted her purity?.

Her fast is not valid and she has to make up that day, because the basic principle is that the menses was still ongoing, and her beginning to fast when she was not sure that she had become pure was embarking upon an act of worship when she was not sure that the conditions of its validity were met, and this means that it is not valid. Smoking is haraam and invalidates the fast

Some people say that fasting is not invalidated by smoking; because it is not food or drink. What is your opinion about this?.

I think that this is a view for which there is no basis. Rather smoking is a kind of drinking; in Arabic they say that one “drinks” a cigarette. Moreover, there is no doubt that it reaches the stomach and the inside of the body, and everything that reaches the stomach and the inside of the body invalidates the fast, whether it is beneficial or harmful, even if a person were to swallow a bead from the masbahah, or a piece of iron, or anything else, it invalidates the fast. So it is not essential that the thing that invalidates the fast, or that is eaten or drunk, should be nourishing or beneficial. Everything that reaches the stomach is regarded as food or drink. They believe – indeed they know – that this is a kind of drink, and if anyone says this then he is being arrogant. 
Moreover, I think that the month of Ramadaan is an opportunity for the one who is sincerely resolved and wants to give up this foul, harmful habit of smoking. I think that it is an opportunity because he is going to abstain from it throughout the day in Ramadaan, and at night he can distract himself from it by means of the food and drink that Allaah has permitted to him, and by frequenting the mosques and attending gatherings of righteous people, and he can keep away from those who have this habit. If he abstains from it throughout the month, then that will be a great help to him in giving it up for the rest of his life. This is an opportunity which smokers should not miss. End quote. 

She was raped by a kaafir during the day in Ramadaan

My friend was raped during her fast last year by a non-islamic man she is desperate to know did this invalidate her fast?.

Praise be to Allaah.
Rape implies force and coercion, and the one who is forced to do something is not held to account for it. Allaah says (interpretation of the meaning): 
“Whoever disbelieved in Allaah after his belief, except him who is forced thereto and whose heart is at rest with Faith; but such as open their breasts to disbelief, on them is wrath from Allaah, and theirs will be a great torment”
[al-Nahl 16:106] 
This verse indicates that those who speak words of kufr because they are forced to do so are free of sin and blame, so long as their hearts remained at rest with faith. If this is the case with kufr, which is the most serious of haraam things, then it applies even more so to things that are less severe: the person who is forced to do them is not held to account for it. 
The Prophet (peace and blessings of Allaah be upon him) said: “Allaah has forgiven my ummah for mistakes, forgetfulness and that which they are forced to do.” Narrated by Ibn Maajah, 2033; classed as saheeh by al-Albaani in Saheeh Sunan Ibn Maajah, 1664. 
So if a woman who was raped did her utmost to resist, but she was not able to escape, there is no sin on her; her fast is valid and she does not have to make it up or offer any kafaarah (expiation). 
Imam Ahmad (may Allaah have mercy on him) said: 
Everything that overwhelms a fasting person, he does not to make it up or do anything else. Al-Mughni, 4/376. 
Shaykh Ibn Baaz was asked about a man who has intercourse with his wife when she does not want to. He replied: 
… If the woman is forced to do it then there is no sin on her and her fast is still valid, but if she let him do it then she has to make up that day and also repent, but she does not have to offer expiation. 
Fataawa al-Shaykh Ibn Baaz, 15/310. 
Shaykh Ibn ‘Uthaymeen said in al-Sharh al-Mumti’ (6/414) on the ruling on having intercourse during the day in Ramadaan: 
If the woman is excused because of ignorance or forgetfulness, or because she was forced to do it, then she does not have to make it up and she does not have to offer expiation. 
We take this opportunity to advise women to fear Allaah and to avoid mixing with men, especially kaafirs and the immoral ones among them, and to keep away from everything that may attract men to them of tabarruj (wanton display), soft speech and flirtatious speech and behaviour. They should choose suitable times and avoid doubtful places or situations. They should adhere to the commands of Allaah and observe hijab and cover themselves, because that will protect them and is good for them in this world and in the hereafter.
 And Allaah is the one Whom we ask to set the Muslims’ affairs straight.

Emission of madhiy does not invalidate the fast

A woman was sexually aroused by her husband during a day of Ramadaan, which made her wet. She does not know if she came or if it was something else that came out. She does not know how many days this happened.

Praise be to Allaah.
Firstly: 
It is permissible for the spouses to be intimate with one another, so long as they are certain that there will be no emission of maniy, because of the report narrated by al-Bukhaari (1927) and Muslim (1106) from ‘Aa’ishah (may Allaah be pleased with her) who said: The Messenger of Allaah (S) used to kiss and touch (his wife) when he was fasting, but he was the most able of you to control his desire. 
If a man is intimate with his wife without having intercourse, then one of the following two scenarios must apply: 
1 – That this intimacy leads to emission of maniy. In this case the fast is invalidated and the one who emitted maniy must make up that day. 
Al-Nawawi (may Allaah have mercy on him) said in al-Majmoo’ (6/349): If he kisses her or is intimate with her, without having intercourse, or he touches a woman’s skin with his hand or otherwise, if he emits maniy then his fast is invalidated, otherwise it is not. The author of al-Haawi and others narrated that there was scholarly consensus that the fast of one who kisses his wife or is intimate without having intercourse and ejaculates is invalidated. End quote. 
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said: If a man is intimate with his wife by touching or kissing the face or touching the private part (without having intercourse) and he ejaculates, then his fast is broken, but if he does not ejaculate then the fast is not broken. End quote. 
Al-Sharh al-Mumti’ (6/388). 
2 – If that intimacy results in emission of madhiy, in this case the fast is not invalidated. 
Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allaah have mercy on him) said: If a man kisses his wife and is intimate with her without having intercourse whilst fasting, all of that is permissible and there is nothing wrong with it, because the Prophet (peace and blessings of Allaah be upon him) used to kiss his wife when he was fasting, and he would be intimate with her whilst he was fasting. But if a man fears that he will fall into that which Allaah has forbidden because he is easily aroused, then it is makrooh for him to do that. If he ejaculates then he must refrain from eating and drinking for the rest of the day, and he must make up that fast. But he does not have to offer any expiation according to the majority of scholars. As for madhiy, it does not affect the fast according to the more correct of the two scholarly opinions, because the basic principle is that the fast remains valid and is not invalidated, and because it is too difficult to avoid it. And Allaah is the Source of strength. End quote. 
Fataawa al-Shaykh Ibn Baaz (15/315) 
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked about a man who was intimate with his wife when he was fasting, and he emitted madhiy; what is the ruling on his fast? 
He replied: If a man is intimate with his wife, and he emits madhiy, his fast is still valid, and he does not have to do anything according to the scholarly view which we regard as correct. That is because there is no evidence to suggest that this breaks the fast, and it is not valid to compare it to maniy, because it is less than it. This view which we favour is the view of al-Shaafa’i and Abu Haneefah, and it was favoured by Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) who said in al-Furoo’: It is more correct. And he said in al-Insaaf: It is the correct view. End quote.

Thirdly: 
If a man is confused in this case and is not sure whether what has come out of him is maniy or madhiy, in most cases it is probably madhiy, because madhiy is that which is emitted when one is intimate, and the fast cannot be judged to have been spoiled on the basis of mere conjecture.

Does not wearing hijab invalidate the fast?

I am a girl who does not wear hijab. Does that mean that my fasting in Ramadaan is invalid?.

Praise be to Allaah.
The believing woman is enjoined to wear hijab. We have discussed hijab on this site in the answer to more than one question, and these answers tackle the matter from different angles. Some of them focus on the ruling on hijab and point out that it is obligatory, as in the answer to question no. 21536. Some quote the definitive evidence for hijab being obligatory, such as the answer to question no. 13998 and11774. Some describe the shar’i hijab, such as the answer to question no. 6991. Other answers speak of the importance of hijab in the life of the believing woman. 
Secondly: 
If a woman does not wear hijab, then she is disobeying her Lord thereby, but her fast is still valid, because sins, including not wearing hijab, do not invalidate the fast, but they detract from its reward, and may cause it to be lost altogether. 
What we urge you to do is wear hijab as well as fast, because the aim of fasting is not merely to give up food and drink, rather the aim is to fast or abstain from haraam things. Hence the Prophet (peace and blessings of Allaah be upon him) said: “Fasting is not just (abstention) from food and drink, rather fasting is (abstention) from idle and obscene talk.” Narrated by al-Haakim and classed as saheeh by al-Albaani in Saheeh al-Jaami’ (5376). 
Idle speech refers to that in which there is no benefit.  
So let your fasting motivate you to obey Allaah and keep away from that which He has forbidden.  
We ask Allaah to help you to do that which He loves and which pleases Him.

She put a face mask made of honey on her face and some of it got into her mouth when she was fasting

Is it permissible to put a face mask made of honey on the face? Please note that it does not require more than a teaspoon of honey. I put this mask on my face in Ramadaan on the basis of a fatwa that I read which said that it is permissible to put any kind of cream on the skin or any product so long as it is not swallowed. Some of the honey entered my mouth and I tasted its sweetness but I did not swallow it. Did that break my fast?.

Firstly: 
There is nothing wrong with using honey on the face to remove freckles, soften the skin and so on, so long as there is no extravagance involved. 
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked: Some of my friends use eggs, honey and milk to treat freckles on the face. Is it permissible for them to do that? 
He replied: It is well known that these things are foods that Allaah has created to nourish the body. If a person needs to use them for any other purpose that is not impure, such as a remedy, then there is nothing wrong with that, because Allaah says (interpretation of the meaning): “He it is Who created for you all that is on earth” [al-Baqarah 2:29]. The word lakum (for you) includes all beneficial uses, so long as there is nothing to indicate that it is haraam. 
With regard to using it for cosmetic purposes, there are other materials which may be used for that purpose instead of this, so it is better to use those. It should be noted that there is nothing wrong with beautification, rather Allaah is Beautiful and loves beauty. But being so extravagant about it so that it becomes a person’s main concern and he thinks about nothing else, and neglects a lot of his spiritual and worldly interests for that, is not appropriate, because it comes under the heading of extravagance, and Allaah does not love extravagance. Secondly: 
If the honey entered your mouth and you tasted it without swallowing, that does not affect your fast. It is permissible for the fasting person to taste food if need be, then spit it out without swallowing. See the answer to question no. 26837

Spending time watching movies and soap operas and playing games in Ramadaan

Some fasting people spend most of the day in Ramadaan watching movies and soap operas on videos and TVs, and playing cards. What is the ruling on that?

Praise be to Allaah.
Muslims, whether they are fasting or not, should fear Allaah with regard to what they are doing and not doing at all times. They must avoid that which Allaah has forbidden, namely watching obscene movies which show things that Allaah has forbidden such as naked and semi-naked pictures, or reprehensible programs, or things which appear on TV that go against the laws of Allaah, such as images, singing, musical instruments and misleading ideas. Every Muslim, whether he is fasting or not, must avoid playing with cards and other kinds of games, because that involves witnessing evil and doing wrong, and because it also causes hardness and disease in the heart, makes a person take the laws of Allaah lightly and makes him find it too difficult to do the things that Allaah has enjoined, such as praying in congregation and other obligations, and makes him fall into doing many haraam things. Allaah says (interpretation of the meaning): 
“And of mankind is he who purchases idle talks (i.e. music, singing) to mislead (men) from the path of Allaah without knowledge, and takes it (the path of Allaah, or the Verses of the Qur’aan) by way of mockery. For such there will be a humiliating torment (in the Hell-fire).
And when Our Verses (of the Qur’aan) are recited to such a one, he turns away in pride, as if he heard them not — as if there were deafness in his ear. So announce to him a painful torment”[Luqmaan 31:6-7] 
And He says in Soorat al-Furqaan, describing the slaves of the Most Merciful (interpretation of the meaning): 
“And those who do not bear witness to falsehood, and if they pass by some evil play or evil talk, they pass by it with dignity”[al-Furqaan 25:72] 
Falsehood (al-zoor) includes all kinds of evil, and the phrase “do not bear witness” means that they do not attend where these things are happening. 
The Prophet (peace and blessings of Allaah be upon him) said: “There will be among my ummah people who will permit adultery, silk, alcohol and musical instruments.” (Narrated by al-Bukhaari in his Saheeh in a mu’allaq majzoom report). What is meant by adultery is illegal sexual relations, and musical instruments include singing. Allaah has forbidden to the Muslims all means that lead to haraam things, and undoubtedly watching bad movies and the evils that are shown on TV are among the means that lead to haraam things or lead one to take such matters lightly without denouncing them. And Allaah is the One Whose help we seek.

by hitting or shouting at students?

I work as a teacher and sometimes I have to hit or shout at the students, because all the teachers do that. I have tried to make myself not do that, but it happened today. Is the fast invalidated by hitting and shouting and getting angry? Do you advise me to give up this profession because of what it leads to of lack of psychological instability, and it is affecting my worship of Allah because I feel guilty after hitting or shouting? Please note that I would do that were it not for my mother who may be upset if I give it up.

Firstly: 
Hitting and shouting are not things that break the fast, even if it is done by way of aggression, so how about if the hitting and shouting are done for the purpose of discipline, teaching and directing? Undoubtedly in that case it is clear that they do not break the fast. Please see the answer to question number 106473

Vaccinations against meningitis do not invalidate the fast. There is nothing wrong with that, but if it is possible to give the injection at night, that is more on the safe side. The one who engaged in foreplay with his wife until he ejaculated has to make up the fast but he does not have to offer expiation

I have a very urgent question pertaining to fasting in Ramadhan. I have read most of the general fatawa with respect to atonement for breaking the fast on purpose, etc. However my circumstance is unique and I need advice. This is very uncomfortable but here goes. During Ramadhan I was very sick and the doctor told me to break my fast and take medication which I did. The doctor instructed me to do so for 5 days and my wife insisted that I follow his instructions may Allah reward her. Anyhow during Ramadhan we engaged in some foreplay, which we have done before on a regular basis even during voluntary fasts that we try to do on a regular basis. It has never been a problem and I know my limits as does my wife. On the fourth day of illness I decided to fast but did not tell my wife as she would have argued that the doctor advised to finish the drugs in full. I was confident that Allah had returned my health and wanted to fast. So I did. That morning we engaged in foreplay and my wife did not stop either when I told her to. Unfortunately, she thought this was a game as we have played it before and continued. Then as I pushed her away the excitement overcame me and I ejaculated. As you can imagine I was shocked. As was my wife when I revealed I was fasting. So do I need to fast 60 days in a row? Or make up one day? Or does this fall under the Hadith of accidentally breaking ones fast as Allah is my witness that was not my intention? Please advise as soon as possible as we are going to hajj inshallah and want to remove this sin/burden from us. What should I do?.

You did well to break your fast when you were very sick, and you also did well to fast when you thought that you were able to, although it would have been better to consult the doctor. So long as you fasted that day and were not harmed by fasting, then you have to make up that day. 
There is no reason why a man should not engage in foreplay with his wife when fasting, if he is confident that he will not spoil his fast or hers. But if he is not confident of that then it is not permissible for him to do it. 
Al-‘Allaamah Mustafa al-Ruhaybaani said in Mataalib Ooli al-Nuha (2/204): Things like kissing are also forbidden, such as embracing, touching, and repeatedly looking for one who thinks that he may ejaculate, and there is no scholarly difference of opinion on this point. End quote. 
If you engaged in foreplay with your wife and felt confident that it would not spoil your fast, then there is no sin on you for this foreplay even if it did spoil your fast. 
But if you thought that you would ejaculate, then you sinned by engaging in this foreplay, and you have to repent to Allaah. 
With regard to fasting, the fast is spoiled in either case, because you ejaculated, whether you intended to break the fast or not. Shaykh Muhammad ibn ‘Uthaymeen (may Allaah have mercy on him) said: If he was intimate with his wife, whether by touching or kissing and so on (less than intercourse), then if he ejaculates his fast is invalidated, but if he does nor ejaculate then he does not break the fast thereby. End quote from al-Sharh al-Mumti’ (6/388). 
You have to fast one day to make up for this day, but you do not have to offer any expiation. Al-Nawawi (may Allaah have mercy on him) said in al-Majmoo’ (6/377); If he spoils his fast with something other than intercourse, such as eating, drinking, masturbating or foreplay that leads to ejaculation, then there is no expiation because the text speaks only of intercourse, and these things do not come under the same heading. End quote.

She kissed a small child and is not sure whether she swallowed some of his saliva

On one of the days of Ramadan, I kissed a small child on his mouth. My question is: I do not remember whether any of the child's saliva entered my mouth or not, and if it did enter my mouth I think it is most likely that I did not realise that this action breaks the fast, because I think that if I had known that I would not have done that action. Do I have to make up those days?.

Your fast is valid and you do not have to make up anything, because you are not certain as to whether you swallowed any of this child's saliva, and an act of worship cannot be invalidated in the case of uncertainty. Even if we assume that you did swallow some of it, you do not have to do anything because you were unaware that this invalidates the fast.

Having an ultrasound to examine the ovaries during the day in Ramadan

I am 15 years old and during the last three months my menstrual cycle has not been regular. Now, two days before Ramadan, I have been menstruating continuously for nearly 6 weeks, and the bleeding has not stopped. I am certain that this blood is menstrual blood and not istihaadah, as the (female) doctor said. The reason for that is a problem with the female hormones. The doctor has made an appointment for me to have an ultrasound to examine and check the state of my ovaries. This date is in the middle of Ramadan, in the morning. The problem is that it requires me to break my fast on this day in order to drink water before the ultrasound. My question is: is it permissible to keep this appointment and is it permissible for me to break my fast on this day, or should I delay the appointment until after Ramadan? Will I be sinning if I do not delay it? Please note that the appointments here are very difficult to get and I may wait another month to do this examination.

Firstly: 
It is permissible for the sick person not to fast in Ramadan and to make up the days that he did not fast, because Allah says (interpretation of the meaning): “and whoever is ill or on a journey, the same number [of days which one did not observe Sawm (fasts) must be made up] from other days. Allaah intends for you ease, and He does not want to make things difficult for you” [al-Baqarah 2:185]. Istihaadah (irregular vaginal bleeding) and ongoing bleeding is a kind of sickness that affects the mind and body, hence there is nothing wrong with carrying out an examination on which the treatment will be based, even if that means that you have to break the fast during the day in Ramadan, although it is better to delay it until night if that is possible. 
It should be noted that x-rays and ultrasounds do not break the fast in and of themselves, so long as the patient does not consume any drink or medicine through the mouth or nose. 
In the answer to question 2299 we have explained in detail the things that do and do not break the fast of one who is fasting. Please refer to this question. 
If the examination requires drinking water or taking medicine, and it is possible to do that before Fajr, then do that. Otherwise it is permissible for you to break the fast. 
Secondly: 
The maximum length of menses according to most of the scholars is 15 days, and it is not possible for it to be any longer than that. Based on that, what the doctor told you is correct, that the bleeding you are experiencing is istihaadah and not menstrual blood. Do sublingual medications (those that are placed under the tongue to dissolve and be absorbed by the body) break the fast?

There is a type of pill which is used by some heart patients. The pill is placed under the tongue and is not swallowed, and is absorbed by the body. Does this pill break the fast?.

The sublingual area – according to doctors – is the area of the body which most rapidly absorbs medicine. Hence the quickest treatment for some heart problems (angina) is a pill which is placed under the tongue, where it is absorbed directly and quickly, and the bloodstream carries it to the heart where it stops the angina attack. 
This kind of medication does not break the fast because it is absorbed in the mouth and none of it enters the stomach. The one who uses it must be careful and make sure that he does not swallow any of it after it dissolves in the mouth and before it is absorbed. 
It says in a statement of the Islamic Fiqh Council: 
The following things are not regarded as breaking the fast: medicines that are placed under the tongue to treat angina pectoris and other problems, so long as one avoids swallowing anything that reaches the throat. End quote.

Ruling on using nasal sprays when fasting

What is the ruling on using nasal sprays when fasting?.

There is nothing wrong with that in cases of necessity, but if it is possible to delay it until night time then that is more on the safe side. End quote.

Ruling on watching movies and TV, and playing cards, during the day in Ramadaan

Some people who are fasting spend most of the day in Ramadaan watching movies and soap operas on video and TV, and playing cards. What is the Islamic view on that?.

Praise be to Allaah.
Those who are fasting and other Muslims should fear Allaah with regard to what they do and what they refrain from doing at all times, and they should beware of that which Allaah has forbidden of watching indecent movies which show things which Allaah has forbidden, such as pictures of naked and semi-naked people and evil words; the same applies to things that appear on TV which go against the laws of Allaah, such as images, songs, musical instruments and misleading advertisements.  
Every Muslim, whether he is fasting or not, should be beware of playing with cards, because of what that involves of witnessing evil and doing evil, and because it also leads to hard-heartedness, sickness in the heart and lack of respect for Allaah’s laws and finding what Allaah has made obligatory to be burdensome, such as praying in congregation and other obligatory duties, and falling into many haraam things. Allaah, may He be exalted, says (interpretation of the meaning): 
“And of mankind is he who purchases idle talks (i.e. music, singing) to mislead (men) from the path of Allaah without knowledge, and takes it (the path of Allaah, or the Verses of the Qur’aan) by way of mockery. For such there will be a humiliating torment (in the Hell‑fire).
7. And when Our Verses (of the Qur’aan) are recited to such a one, he turns away in pride, as if he heard them not — as if there were deafness in his ear. So announce to him a painful torment”
[Luqmaan 31:6-7] 
And Allaah says in Soorat al-Furqaan, describing the slaves of the Most Merciful (interpretation of the meaning):  
“And those who do not bear witness to falsehood, and if they pass by some evil play or evil talk, they pass by it with dignity”
[al-Furqaan 25:72]. 
Falsehood includes all kinds of evil, and what is meant by “[they] do not bear witness” is that they are not present. The Prophet (peace and blessings of Allaah be upon him) said: “There will be among my ummah people who regard adultery, silk, alcohol and music as permissible.” Narrated by al-Bukhaari in his Saheeh in a mu’allaq, majzoom report. What is meant by music is singing and musical instruments. Allaah has forbidden to the Muslims the means that cause them to fall into evil. Undoubtedly watching evil films and the evils that are shown on television are means that cause one to fall into evil or to become careless and not denounce it. And Allaah is the One whose help we seek. End quote.

Why isn’t the puffer for asthma regarded as breaking the fast?

I would like a detailed answer: why isn’t the puffer that is used by people who have asthma regarded as breaking the fast?.

Praise be to Allaah.
The puffer is a container in which there is a liquid medicine composed of three things: chemical substances (medical preparation), water and oxygen. 
When pressure is applied to the puffer, the medicine comes out in the form of a mist. If the patient takes a deep breath in when applying pressure to the puffer, this mist enters the airway (trachea), but some of it remains in the pharynx, and a very small amount of it may enter the oesophagus.  
Some contemporary scholars are of the view that using a puffer invalidates the fast. They said: Because the contents of the puffer may reach the stomach via the mouth, so it breaks the fast. 
But most contemporary scholars are of the view that using this puffer does not break the fast, and this view is the correct one. They quoted a number of things as evidence for this: 
1.
The basic principle is that the fast remains valid, and this fact cannot be altered except when there is certain proof. Whether part of the mist from the puffer reaches the stomach is something uncertain: it may enter the stomach or it may not, because the basic principle is that this substance goes to the respiratory system, but some of it may enter the stomach. With this uncertainty we cannot say that it invalidates the fast. This is the answer to the evidence for the first opinion. 
2.
Assuming that some of this medicine does actually enter the stomach, it is forgiven, and does not invalidate the fast, by analogy with rinsing the mouth and using the miswaak. 
With regard to rinsing the mouth: when the fasting person rinses his mouth, some of that water remains in his mouth, and some of that water may go down to the stomach. Hence if he rinses his mouth with water in which there is a radioactive substance, that radioactive substance will appear in his stomach after a while, which confirms that some of the water used for rinsing the mouth does go down into the stomach. But this part that goes down into the stomach is a very small amount, which is overlooked in sharee’ah. The ruling is that the fast is still valid if one rinses the mouth. The amount of medicine from a puffer that reaches the stomach – if any – is smaller than the amount of water that reaches the stomach when one rinses the mouth, so it is more likely that it does not break the fast. 
As for the siwaak, it contains a substance that dissolves in the saliva and goes down into the pharynx, and then to the stomach. But Islam overlooks this, and does not regard it as invalidating the fast, because it is a small amount and is not intentional. Similarly the part that may go down into the stomach from the puffer is small, and the patient does not intend for it to enter the stomach, so it does not break the fast, by analogy with the miswaak. 
Thus the strength of the second view is apparent. This is the view favoured by our contemporary scholars: Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allaah have mercy on him), Shaykh Muhammad ibn al-‘Uthaymeen, Shaykh ‘Abd-Allaah ibn Jibreen, and the scholars of the Standing Committee. Does having a gastroscopy invalidate the fast?

Does having a gastroscopy invalidate the fast?.

Praise be to Allaah.
The gastroscope is a medical instrument that is inserted into the stomach via the mouth, and is used either to take a picture of the stomach or to take a sample for examination, or for other medical purposes, then after the procedure is complete, the instrument is removed via the mouth. 
The scholars differed as to whether, if something reaches the stomach, it invalidates the fast in all cases, whether it is provides nourishment or not, or does it not invalidate the fast if it does not provide nourishment? 
Three madhhabs are of the view that the fast is broken by everything that enters the stomach: the Maalikis, the Shaafa’is and the Hanbalis. 
Based on that, this gastroscopy does invalidate the fast. 
The Hanafis agreed with them that everything that reaches the stomach invalidates the fast, but they stipulated that it should remain in the stomach. 
Based on that, gastroscopy does not invalidate the fast, because it does not remain in the stomach, rather it is removed once the procedure is completed.

Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) was of the view that the fast is not broken unless a nourishing substance reaches the stomach. He (may Allaah have mercy on him) said: The more correct view is that the fast is not broken by swallowing something that does not provide nourishment, such as swallowing a pebble. End quote from Majmoo’ al-Fataawa (20/528). 
Based on this view, this gastroscopy does not invalidate the fast, and this view is more likely to be the correct one, because the text only indicates that eating and drinking spoil the fast. Allaah says (interpretation of the meaning): 
“and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night), then complete your Sawm (fast) till the nightfall
[al-Baqarah 2:187]. 
The gastroscope is neither food nor drink, and is not akin to food or drink, because the body does not benefit from it and is not nourished by it. 
But, if any kind of greasy substance is put on the gastroscope to make it easier to insert it into the stomach, or some saline solution is introduced via the gastroscope to clean it and make it easier to take images, then the fasting person’s fast is invalidated when this substance reaches the stomach, because the body will absorb it and be nourished by it, so it is like food and drink. 
Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) said in al-Sharh al-Mumti’ (6/370, 371) – when explaining that everything that reaches the stomach invalidates the fast according to the madhhab of Imam Ahmad – : If a person has a gastroscope inserted and it reaches the stomach, then this breaks the fast [i.e., according to the Hanbali madhhab]. But the correct view is that it does not break the fast unless there is any grease or the like on the gastroscope that may reach the stomach via the gastroscope. In that case it breaks the fast, and it is not permissible to use it during an obligatory fast except in case of necessity. End quote. 
In a statement of the Islamic Fiqh Council it says: 
The following things are not regarded as breaking the fast: … gastroscope if it is not accompanied by introduction of fluids (solutions) or any other substance. End quote. 
Majallat al-Majma’ (10/2/453-455). 
To sum up: If the gastroscope is inserted into the stomach without introducing any other substances, then it does not break the fast, but if some greasy substance or anything else is introduced with it then it does invalidate the fast.

Does breathing artificial oxygen break the fast?

Some patients who have difficulty breathing need to breathe artificial oxygen whilst fasting. Does this have any effect on the fast?.

The oxygen that is given to some patients does not invalidate the fast, because nothing else is added to this oxygen, so it comes under the same ruling as breathing natural air. 
Hence in a statement of the Islamic Fiqh Council it says: 
The following things are not regarded as things that break the fast: … oxygen. End quote.

He had intercourse with his wife when the muezzin was giving the call to Fajr prayer

I had intercourse with my wife at dawn in Ramadan, just before the adhaan and when the adhaan came, I was still in that situation with my wife, but I stopped before the muezzin finished giving the call to prayer. Do I have to do anything? As I thought that I could have intercourse with her before the muezzin finished the adhaan.

Praise be to Allaah.
Firstly: 
If the muezzin gives the call to prayer as dawn is breaking, then it is obligatory to refrain from things that break the fast from the break of dawn until the sun sets. So once the muezzin says Allaahu akbar, you have to refrain from eating, drinking, having intercourse and everything that breaks the fast. 
Al-Nawawi (may Allah have mercy on him) said: If dawn breaks and a person has food in his mouth, he should spit it out, and if he spits it out then his fast is valid, but if he swallows it then he has broken the fast. If dawn breaks and he is having intercourse but he stops immediately, his fast is valid. But if dawn breaks and he is having intercourse and he knows that dawn has broken, but he continues having intercourse, then his fast is invalidated. No difference of opinion concerning that is known among the scholars. And he has to offer expiation for that according to our view. End quote from al-Majmoo’ (6/329). 
He also said (6/333): We stated that if dawn breaks and a person has food in his mouth, then he should spit it out and complete his fast, but if he swallows it after he knows that dawn has come, his fast is invalid. There is no difference of opinion concerning this, and the evidence for it is the hadeeth of Ibn ‘Umar and ‘Aa’ishah (may Allah be pleased with them) according to which the Messenger of Allah (blessings and peace of Allah be upon him) said: “Bilaal gives the adhaan at night, so eat and drink until Ibn ‘Umm Maktoom gives the adhaan.” Narrated by al-Bukhaari and Muslim. In al-Saheeh there are many similar hadeeths. End quote. 
Based on that, if the muezzin in your neighbourhood gives the call to prayer when dawn breaks, then you have to stop having intercourse as soon as you hear the first takbeer of his adhaan. 
If you know that the muezzin gives the call to prayer before dawn breaks or you are not sure whether he gives the call before dawn breaks or after, then you do not have to do anything further, because Allah has permitted us to eat and drink and have intercourse until the dawn comes. Allah says (interpretation of the meaning): “So now have sexual relations with them and seek that which Allaah has ordained for you (offspring), and eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night)” [al-Baqarah 2:187]. 
The scholars of the Standing Committee for Issuing Fatwas were asked: What is the ruling on one who completes his sahoor and drinks water at the time of the adhaan or one quarter of an hour after the adhaan of Fajr? 
They replied: If the person mentioned in the question knows that this is before dawn appears, then he does not have to make up the fast, but if he knows that it is after dawn appears, then he does have to make up the fast. 
But if he does not know whether his eating or drinking came after dawn appeared or before, then he does not have to make up the fast, because the basic principle is that it is still night. But the believer should be careful about his fast and should refrain from things that break the fast when he hears the call to prayer, unless he knows that this call comes before dawn. End quote.

Secondly: 
If you were unaware of this ruling and you thought that abstaining was only required after the end of the adhaan, then you do not have to offer any expiation, but you should make up that fast in order to be on the safe side, as well as repenting and seeking forgiveness for your falling short in learning what is required of you in your religion.

Husband forcing his wife to have intercourse

Is it permissible for a man to force his wife or slave to have intercourse if she refuses?.

Praise be to Allaah.  
The woman does not have the right to refuse her husband, rather she must respond to his request every time he calls her, so long as that will not harm her or keep her from doing an obligatory duty. 
Al-Bukhaari (3237) and Muslim (1436) narrated that Abu Hurayrah (may Allaah be pleased with him) said: The Messenger of Allaah (peace and blessings of Allaah be upon him)  said: “If a man calls his wife to his bed and she refuses, and he spends the night angry with her, the angels curse her until morning.” 
If she refuses with no excuse, she is disobeying and is being defiant (nushooz), and he is no longer obliged to spend on her and clothe her. 
The husband should admonish her and remind her of the punishment of Allaah, and forsake her in her bed. He also has the right to hit her, in a manner that does not cause injury. Allaah says (interpretation of the meaning): 
“As to those women on whose part you see ill-conduct, admonish them (first), (next) refuse to share their beds, (and last) beat them (lightly, if it is useful); but if they return to obedience, seek not against them means (of annoyance). Surely, Allaah is Ever Most High, Most Great”
[al-Nisa’ 4:34] 
Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) was asked what a husband should do if his wife refuses him when he asks for intimacy. 
He replied: 
It is not permissible for her to rebel against him or to withhold herself from him, rather if she refuses him and persists in doing so, he may hit her in a manner that does not cause injury, and she is not entitled to spending or a share of his time [in the case of plural marriage].” Majmoo’ al-Fataawa, 32/279. 
And he was asked about a man who has a wife who is rebellious and refuses intimacy – does she forfeit the right to maintenance and clothing, and what should she do? 
He replied: 
She forfeits her right to maintenance and clothing if she does not let him be intimate with her. He has the right to hit her if she persists in being defiant. It is not permissible for her to refuse intimacy if he asks for that, rather she is disobeying Allaah and His Messenger (by refusing). In al-Saheeh it says: “If a man calls his wife to his bed and she refuses, the One Who is in heaven will be angry with her until morning comes.” 
From Majmoo’ al-Fataawa, 32/278. The hadeeth was narrated by Muslim, 1736. 
So the wife should be admonished first, and warned against defiance (nushooz) and of the anger of Allaah and the curse of the angels. If she does not respond, then the husband should forsake her in her bed, and if she does not respond to that, then he may hit her in a manner that does not cause injury. If none of these steps are effective, then he may stop spending on her maintenance and clothing, and he has the right to divorce her or to allow her to separate from him by khula’ in return for some financial settlement, such as giving up the mahr. 
Similarly a slave woman does not have the right to refuse her master’s requests unless she has a valid excuse. If she does that she is being disobedient and he has the right to discipline her in whatever manner he thinks is appropriate and is allowed in sharee’ah.

How to treat a wife from among the People of the Book

The ayah in surah maida about not taking the jews and christians as awliya does this mean friends or protectors because some people say it means just helpers but in the englishtranslate this to mean friends if it does mean friends how do befriend are non-muslim wife or treat her accordingto shariah.

Praise be to Allaah.  
Interacting with Jews, Christians and all other kuffaar is subject to guidelines and regulations that are set out in Islamic sharee’ah. These guidelines include the following: 
Firstly: 
It is permissible to speak with the kaafirs and to discuss permissible matters with him. 
Secondly: 
It is not permissible to take the kuffaar as close friends (awliya’). Taking them as close friends may happen in many ways, such as mixing with them, feeling comfortable with them, living with them, taking them as close friends, loving them, preferring them over the believers, and so on. Allaah says (interpretation of the meaning): 
“You (O Muhammad) will not find any people who believe in Allaah and the Last Day, making friendship with those who oppose Allaah and His Messenger (Muhammad), even though they were their fathers or their sons or their brothers or their kindred (people)”
[al-Mujaadilah 58:22] 
Thirdly: 
It is permissible to interact with the kuffaar to buy, sell, lend and so on. It was narrated in saheeh reports that the Prophet (peace and blessings of Allaah be upon him) borrowed a weapon from Safwaan ibn Umayyah, and that he bought food from the Jews. 
With regard to how to treat a wife from among the people of the Book (i.e., a Jewish or Christian woman), Allaah says in His Book (interpretation of the meaning): 
“Allaah does not forbid you to deal justly and kindly with those who fought not against you on account of religion nor drove you out of your homes. Verily, Allaah loves those who deal with equity”
[al-Mumtahanah 60:8] 
So it is permissible to treat a Jewish or Christian wife justly and kindly, and there is nothing wrong with that; it does not come under the heading of the type of close friendship and strong bonds that is forbidden. 
Al-Kaasaani said in Badaa’i al-Sanaa’i’ (2/270): 
It is not permissible for a Muslim to marry a mushrik woman, because Allaah says (interpretation of the meaning): 
“And do not marry Al-Mushrikaat (idolatresses) till they believe (worship Allaah Alone)”
[al-Baqarah 2:221] 
But it is permissible to marry a woman from among the people of the Book, because Allaah says (interpretation of the meaning): 
“(Lawful to you in marriage) are chaste women from the believers and chaste women from those who were given the Scripture (Jews and Christians) before your time”
[al-Maa'idah 5:5] 
The difference is that the basic principle is that a Muslim is not permitted to marry a kaafir, because marrying a kaafir woman and mixing with her at the same time when there is religious animosity will not produce the tranquility and love which are the basic purpose of marriage, but it is permitted to marry a woman from among the People of the Book in the hope that she will become Muslim, because she believes in the Books of the Prophets and Messengers in general, but she does not believe in a comprehensive and correct manner, because what she was taught is different from what is real. It is likely that when the facts are pointed out to her, she will accept them.  So her husband should call her to Islam and tell her how things really are. So when a Muslim marries such a woman there is the hope that she will become Muslim, so it is permissible to marry them for this purpose. This is unlike the case of a mushrik woman, because by choosing to associate others in worship with Allaah and not to believe in the Prophets and Messengers, this indicates that she does not pay any attention to proof and evidence and will not respond to da’wah, and will rather continue to follow the way of her forefathers and to follow her whims and desires. So there will remain that religious animosity which will not produce the tranquility and love which are the basic purpose of marriage, so it is not permissible to marry such a woman. 
And he said in Haashiyat al-‘Adawi (1/273): 
The phrase “we forsake those who disbelieve in You” means we cast aside any positive feelings towards those who worship anyone other than You, and we will not love his way or feel any inclination towards it. But this does mean that we are not allowed to marry a woman from among the people of the Book, because marrying her may attract her to the religion of Islam, as marriage is a type of interacting with others and what is meant here is to hate the way of kufr.

His wife is weak in religious commitment – what should he do?

I am a young man, thirty years old. Before I got married I was not committed, but now – praise be to Allaah – I have been blessed with guidance. I got married to a girl who graduated from the Faculty of Islamic Studies and I was happy about that because I thought that she would help me to obey Allaah. But after getting to know her, I found out that she is a very ordinary girl and she is not committed at all, and she has many negative qualities, such as: 
She cannot denounce any evil action, whether major or minor. Rather she even does some evil actions such as watching TV, gossiping, and doing few acts of worship. But she also has some good qualities, such as being good and patient, and she performs all her wifely duties and takes care of the house. 
What upsets me is that I wanted someone who would help me to be more committed by marrying a woman who was religiously committed, but I found that the one who I thought was religiously committed needs someone to help her.  
This is my problem. I hope that you can help me find a solution. Thank you very much.

The problem that you describe is one that is faced by many young men who thought that their wives could learn and make da’wah, and that they would strive hard in worship and help their husbands to be religiously-committed, no matter how much the husband fell short in that. But in fact the wife cannot be influenced by anybody as much as her husband. So if the husband does not set a good example, the wife’s commitment will soon become weak. This is what usually happens. This does not mean that there are not good situations in which the woman is the example who leads her husband along the path of guidance. 
The fact that you have found out that your wife is an ordinary girl does not mean that you have failed, and it should not be a cause of regret. Rather that should be a motive for you to seek the reward for calling her to guidance. 
What you have mentioned of her good qualities will help you to achieve that, in sha Allaah. 
So you should be the one who calls her, reminds her and advises her… fill her free time with beneficial things such as tapes, books and magazines.  Do not give up on rebuking her if she gossips or watches TV, but do that in a gentle, compassionate and loving manner. 
Try to make her join an organization for memorization of Qur’aan, or get her to attend public lectures with you, or to form ties with some righteous families. These are the best ways in which you can help your wife to strengthen her faith. 
Perhaps what you mention about her not worshipping much is related to your own shortcomings in that regard, or to your neglecting to get her to join in. Try to help her and remind her of the virtue of naafil prayers, the reward for praying qiyaam al-layl and fasting. Do as many of these acts of worship with her as you can. 
Be the qawwaam (leader; protector and maintainer) of your wife, prevent her  from doing haraam things or doubtful things.  
Ask of Allaah, saying, “Our Lord! Bestow on us from our wives and our offspring the comfort of our eyes, and make us leaders of the Muttaqoon (the pious)” [al-Furqaan 25:74 – interpretation of the meaning].
